1. Acceptance of These Terms

By accessing our website, submitting a form, enrolling in a squad, booking track time or taking part in an event we time, you confirm that you have read and accepted these Terms of Service. If you do not agree with any part of them, you should not use the relevant service.

Where you act on behalf of a club, a venue or another organisation, you confirm that you have authority to accept these terms on its behalf, and references to you include that organisation. These terms apply together with any specific agreement, entry form or event regulation that we provide for a particular service, and where a conflict exists the specific document governs for that service.

2. Who We Are

Asiina Cycling Team is a computer integrated systems design practice focused on track cycling. We provide coaching, rider development, event timing, venue scheduling, youth clinics and team logistics support from our base at 2655 N Garden Dr, Lehi - 84048-5787, United States (US).

You can reach us by email at service@asiinacycling.lat or by telephone at +18608945939. Throughout these terms, we, us and our refer to Asiina Cycling Team, and you refers to the person or organisation using our services.

3. Eligibility

You must be able to form a binding contract to use our paid services. Where a rider is under the age of majority in their location, a parent or guardian must accept these terms and remain responsible for the rider obligations set out below.

Certain programmes require a minimum level of riding competence, a suitable track bicycle and a current safety helmet. We may decline or withdraw participation where a rider does not meet the requirements of a particular session, or where continuing would put the rider or others at risk.

4. Our Services

We provide six core services: Track Program Coaching, Rider Development Squads, Event Timing Systems, Venue Scheduling, Youth Track Clinics and Team Logistics Support. Each service is delivered by our crew and may be combined with others as part of a seasonal programme.

We may add, change or retire a service over time. Where a change affects an existing commitment, we will give reasonable notice and, where appropriate, offer an alternative or a refund in line with these terms.

5. Bookings and Enrolment

A booking or enrolment is confirmed only when we accept it and, where a fee applies, when payment is received or an agreed arrangement is in place. Availability is limited, and we allocate places in the order in which confirmed requests are received.

You are responsible for providing accurate information at the time of booking, including rider details, emergency contacts and any medical condition that a coach should know about. Supplying false or misleading information may invalidate a booking and is a breach of these terms.

6. Fees and Payment

Fees for programmes, clinics, timing and logistics are set out in the relevant description or quotation. All fees are stated in United States dollars unless we agree otherwise in writing. Payment is due by the date shown on the invoice or booking confirmation.

Where a payment is overdue, we may pause a service until the balance is settled. We may also recover reasonable costs of collecting an unpaid balance where that is permitted by law. Taxes are applied where required, and you are responsible for any bank or transfer charge that your own provider applies.

7. Cancellations and Refunds

If you cancel a booking, any refund depends on how much notice you give and on the cost we have already committed. As a general guide, a cancellation made well before a session can usually be credited or refunded, while a late cancellation may not be refundable because the place can no longer be filled.

If we cancel a session, we will offer a replacement session, a credit or a refund of the affected fee. We are not responsible for indirect costs such as travel, and we recommend that participants arrange their own cover for expenses that could be lost through a cancellation.

8. Rider Responsibilities

Riders are responsible for arriving on time, in suitable clothing, with a helmet that fits and a bicycle in safe working order. Where we provide a loaner bike, the rider must treat it with care and report any damage immediately.

Riders must follow the instructions of coaches and officials at all times. The banking of a track is demanding and leaves little room for improvisation, so an instruction given for safety is not optional. Repeated failure to follow safety instructions may result in removal from a session without refund.

9. Safety and Conduct

Safety is the first consideration in everything we do. We maintain procedures for warm up, track entry, passing, leaving the banking and responding to an incident, and every participant is expected to learn and follow them.

Before a rider joins a fast group, a coach checks that the rider can hold a line, signal a change of direction and stop safely on the apron. A rider who is not yet ready for a group is not pushed into one, because the confidence earned on an empty stretch of track is worth more than a place in a session that felt too fast. We ask families and teammates to respect that judgement and to trust the sequence of progression we have built.

We expect respectful conduct from everyone at the venue, including riders, families, coaches and visitors. Abuse, harassment, discrimination or deliberate disruption is not tolerated and may lead to immediate removal and, where necessary, a report to the relevant authority. Any incident is recorded, reviewed and, where a lesson can be learned, shared with the crew so that our practices keep improving rather than merely repeating.

10. Coaching and Development

Coaching is a partnership, not a guarantee. We will provide a well structured plan, honest feedback and careful measurement, but athletic results depend on many factors beyond our control, including attendance, recovery, health and competition. We do not promise a particular ranking, selection or personal best.

Training data and coaching notes are shared with the rider and, for a young rider, with a parent or guardian. They are confidential to that relationship and may not be republished or shared with a third party without our agreement.

A rider may pause or leave a programme at any time, and we will hand over the relevant records on request so that progress is not lost. Where a rider moves to another coach, we are happy to explain the methods behind our plans, because a well run transition serves the rider better than a guarded one.

11. Event Timing Systems

Our timing systems are provided to record crossings, compute results and publish start lists. While we design them to be reliable and to record locally before publishing, we cannot promise that a system will never be interrupted by equipment failure, a network fault or an event beyond our control.

Where a result is disputed, we will review our event logs, which are the authoritative record. Our decision on the facts shown by the logs is final for the purposes of the event we are timing, without prejudice to any right of appeal under the rules of the governing body that sanctions the race.

Venues that adopt our timing systems receive training for their own staff, a written run book for race night and a support channel for the first season. We regard a handover as complete only when the local crew can run a timed session without us in the booth, because a system that depends on a distant designer is a liability rather than an asset.

12. Venue Scheduling

Venue Scheduling allocates track time according to the rules of the venue and the calendar we operate. A confirmed slot is a commitment by both sides: you agree to use it as booked, and we agree to make the track and the required support available.

If a venue or a club needs to release a slot, it should do so as early as possible so that the time can be offered to someone else. Repeated late releases may reduce priority for future bookings, because a track is a shared resource and fairness depends on predictable behaviour.

13. Youth Track Clinics

Youth Track Clinics are designed for riders aged nine to sixteen and are delivered with safety as the dominant concern. A parent or guardian must complete the enrolment information, including emergency contacts, before a young rider takes part.

Young riders must be collected promptly at the end of a clinic, and families should tell us in advance if a different adult will collect a rider. Coaches are required to follow our child protection standards, and any concern about the welfare of a young rider should be raised with us immediately.

14. Team Logistics Support

Team Logistics Support covers travel planning, equipment manifests, entries and related administration. When you ask us to make a booking or an entry on your behalf, you authorise us to act as your agent for that specific purpose and you agree to provide accurate information and prompt payment of any third party cost.

We take care to choose reliable suppliers, but we are not the provider of travel, accommodation or transportation, and we are not responsible for a failure by an unrelated supplier. Where a supplier changes a plan, we will tell you quickly and help you find a workable alternative.

15. Intellectual Property

The website, the timing software, the scheduling tools, the coaching materials and all related text, design and code are owned by Asiina Cycling Team or licensed to us, and they are protected by intellectual property law. You may use them only as needed to receive the service we have agreed to provide.

You may not copy, modify, distribute, resell or reverse engineer our materials without written permission. Where you send us content such as a photograph or a comment, you grant us permission to use it for the purpose for which you provided it, and you confirm that you have the right to do so.

16. Acceptable Website Use

You agree to use our website lawfully and respectfully. You must not attempt to gain unauthorised access to our systems, interfere with their operation, introduce malicious code, scrape data at scale or use the site in a way that damages other users.

We may suspend access to the website where we reasonably believe it is being misused, and we may take legal steps where misuse causes loss or harm. Automated access is permitted only where we have agreed to it in writing, for example through a documented integration for a timing feed.

17. Third Party Services

Some parts of our service depend on third parties, such as hosting, payment processing and email delivery. Those providers have their own terms, and your use of them may be subject to additional conditions.

We choose providers carefully, but we cannot control them completely. Where a third party service fails or changes, we will work to restore the affected part of our service as quickly as we can and, where appropriate, offer an alternative arrangement.

18. Disclaimers

Our website and services are provided on an as available basis. To the fullest extent permitted by law, we disclaim implied warranties that are not expressly stated in these terms, including any implied warranty of merchantability or fitness for a particular purpose.

Nothing on our website is medical, legal or financial advice. Track cycling carries inherent risk, and every participant accepts that risk as a condition of taking part. We describe our methods and our safety practices honestly, but we cannot remove the fact that a bicycle ridden at speed on a banked surface involves danger.

19. Limitation of Liability

To the fullest extent permitted by law, Asiina Cycling Team is not liable for indirect, incidental, special or consequential loss, including lost profits, lost opportunity or lost data, arising from the use of our website or services.

Where liability cannot be excluded, our total liability for a claim connected to a service is limited to the amount you paid us for that service in the twelve months before the claim arose. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

20. Indemnity

You agree to indemnify Asiina Cycling Team against reasonable loss, cost or expense that arises from your breach of these terms, your misuse of our services, or your infringement of the rights of another person or organisation.

This indemnity does not apply where the loss is caused by our own negligence or by our breach of these terms. We will tell you promptly about any claim we receive that falls within this section and will work with you on a reasonable response.

21. Suspension and Termination

We may suspend or end your access to a service if you breach these terms, if a payment is seriously overdue, or if continuing would put the safety of others at risk. Where the situation can be corrected, we will normally give you the chance to do so first.

You may stop using our services at any time. Ending a service does not remove obligations that have already accrued, such as payment for work already performed, and it does not affect the parts of these terms that are intended to continue, including intellectual property, disclaimer, liability and governing law provisions.

22. Governing Law

These terms are governed by the laws of the State of Utah and the applicable laws of the United States. Any dispute that cannot be resolved between us will be brought before a court of competent jurisdiction in Utah, unless the law requires a different forum.

Before beginning formal proceedings, we ask that you contact us so that we can try to resolve the matter directly. Most misunderstandings are settled quickly by a conversation, and we prefer that outcome for everyone involved.

23. Changes to These Terms

We may update these terms to reflect changes in our services or in the law. When we make a material change we will update the date at the top of this page and, where appropriate, tell you through our usual channels.

Continuing to use a service after an update means that you accept the revised terms. If you do not agree with a change, you should stop using the affected service and contact us to settle any outstanding matter.

24. How to Contact Us

If you have a question about these terms or about a service, please get in touch. We answer every serious enquiry within two working days wherever possible.
